I. GENERAL PROVISIONS
- These Regulations specify the method of concluding an accommodation rental agreement, the rules of settlement, and the cancellation of a reservation as part of the Service provided electronically by the Service Provider.
- These Regulations are the regulations referred to in Art. 8 section 1 point 1 of the Act of July 18, 2002 on the provision of electronic services.
- These Regulations define the conditions of stay, rights and obligations of the Guest.
II. DEFINICJE
Service provider – MERIZON SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, 6793107516, ul. Reformacka 15B, 32-020, Wieliczka
Offer – accommodation (summer house) on the premises of the “Domki Piwniczna” Summer Houses in Piwniczna Zdrój, ul. Sucha Dolina 27, offered by the Service Provider in order to conclude an accommodation rental agreement via the Website.
Guest – a natural person with full legal capacity, a legal person or an organizational unit referred to in Art. 33 1 of the Civil Code, concluding an accommodation rental agreement with the Service Provider.
Accommodation rental agreement – a legal act concluded via the Website upon confirmation of the reservation, regulating all mutual rights and obligations of the Service Provider and the Guest. These Regulations constitute an integral part of the concluded contract. The provisions of the Act of June 21, 2001 on the protection of tenants’ rights and municipal housing resources do not apply to the agreement.
Website – presentation of the Service Provider’s Offer on the Internet, enabling the conclusion of an online accommodation rental agreement;
Electronic Reservation Form – a form available on the Website enabling the conclusion of an accommodation rental agreement;
Total Price of the Service – the total price of the service indicated when making the reservation, including all amounts due under the concluded Accommodation Rental Agreement in respect of taxes and all public levies.
Website privacy and cookies policy – a document specifying detailed rules for the processing of personal data and the use of cookies. The privacy and cookies policy constitutes Annex 1 to the Regulations and is available at www.domkipiwniczna.pl
III. GENERAL PROVISIONS
- Types and scope of services provided electronically:
- concluding accommodation rental agreements;
- sending e-mails in which the Service Provider confirms the creation of the reservation along with its conditions and payment deadline;
- rules for registering and using the Account on the Website.
- The use of the Website is possible provided that the IT system used by the Guest meets the following minimum technical requirements:
- Internet browsers, i.e. Firefox, Chrome, Internet Explorer in the current version,
- any program for viewing PDF files,
- having an active and properly configured e-mail account.
IV. HOW TO CONCLUDE A CONTRACT
- The subject of the Agreement is the rental of an accommodation offered by the Service Provider via the Website. The contract is concluded via the Electronic Reservation Form in the following steps – the Guest specifies the exact start and end date of the stay, selects a place to stay, declares the number of people,
- After the Guest provides all necessary data, a summary of the reservation will be displayed. In order to place a reservation, it is necessary to provide personal data marked as mandatory in the Electronic reservation form, accept the content of the Regulations, and send the reservation by pressing the [Place order] button.
- The accommodation rental agreement is considered concluded when the Service Provider accepts the Electronic Reservation Form, which is confirmed by displaying a message confirming acceptance of the reservation and providing its number.
- After concluding the contract, the Guest receives an e-mail confirming the concluded contract along with all its important provisions, in particular the Total Price of the Service, the date and method of payment as well as the conditions for accepting and canceling the reservation. If prepayment is required, the payment deadline is indicated along with information on the consequences of ineffective expiry of the payment deadline. Failure to pay the prepayment within the deadline specified in the e-mail results in the cancellation of the reservation and the Service Provider’s withdrawal from the concluded Accommodation Rental Agreement without setting an additional deadline for the performance of the service.
- It is not allowed to sublet the accommodation that is the subject of the Offer or to transfer or make it available to third parties.
V. CANCELLATION AND CHANGE OF RESERVATION
- Failure to perform the activities described in the message containing confirmation of acceptance of the reservation within the required deadline results in automatic cancellation of the reservation and withdrawal by the Service Provider from the concluded Agreement without setting an additional deadline for the performance of the service.
- Cancellation or change of reservation is possible via the link included in the e-mail or by contacting the Service. Using the link in the email allows for automatic, immediate cancellation reservation on the terms accepted in the ordering process in the Electronic Reservation Form.
VI. COMPLAINTS
- If it is found that the provision of services is inconsistent with the Agreement, the Guest should report any complaints in writing or by e-mail within 14 days from the end of the stay to kontakt@domkipiwniczna.pl
- The complaint should include the guest’s data: name, surname, e-mail address provided during the reservation, indication of the problem.
- The Service Provider considers the complaint within 14 days of its receipt, and informs the Guest about it in the same form: in writing or electronically.
- If the information provided in the complaint requires supplementation, the Service Provider will ask for it to be supplemented within the deadline set for examining the complaint. The deadline referred to in point 3 runs for the Service Provider from the moment of receipt of the completed complaint.
- In the event of refusal to accept the complaint, the Service Provider is obliged to justify in detail the reasons for the refusal in writing or in electronic form.
VII. PERFORMANCE OF THE AGREEMENT, CONDITIONS OF STAY, RIGHTS AND OBLIGATIONS OF THE GUEST
- Accommodation is provided upon opening the entrance door using the code provided to the electronic lock, sent via text message 24 hours before the start of the stay.
- Early check-in or late check-out is only possible after prior confirmation by the administration at kontakt@domkipiwniczna.pl or by phone: +48 530315828
- The sliding entrance gate must be opened and closed manually each time.
- The car should be parked in the area behind the entrance gate, marked with the “Parking” sign. Parking for guests is free, monitored and unguarded. Each accommodation space (summer house) is entitled to one free parking space. The Service Provider does not guarantee the availability of additional parking spaces. The car should be parked so as not to obstruct the path of other users. Entry outside the parking area is prohibited. The parking lot is marked on the overview map on the website domkipiwniczna.pl
- The entrance door is opened using a code for the electronic lock or a proximity card located in the house near the “card holder”. After your stay, leave the card on the table or countertop. For security reasons, we recommend carrying your card with you when leaving the cottage.
- The power supply is turned on after inserting the card into the card holder.
- Guests can use free Internet access.
- The Guest is obliged to report any defects or deficiencies found in the accommodation immediately to the Service Provider by e-mail: kontakt@domkipiwniczna.pl or by phone at +48 530315828
- In the area of the “Domki Piwniczna” Holiday Homes in Piwniczna Zdrój, there is a night curfew from 10 p.m. to 7 a.m.
- The area of the “Domki Piwniczna” Holiday Homes is lit, fenced and monitored. The site plan is marked on the overview map available on the website domkipiwniczna.pl
- The guest is obliged to use the accommodation in a manner consistent with its intended purpose, the conditions specified in the Regulations and the principles of social coexistence, in particular in a manner that does not disturb the peace of third parties.
- The guest is obliged to properly secure the accommodation, carefully close the entrance door, patio doors and windows each time he or she leaves the accommodation, carefully store the access card and not disclose the code or access card to third parties.
- Guests staying at Piwniczna Cottages are asked to follow the rules of safe and polite recreation. The principle of respecting good neighborly relations applies throughout the entire stay.
- Guests are asked to read the instructions for use of fire extinguishers, which are located in each accommodation.
- The Service Provider has the right to terminate the contract with immediate effect if the Guest or an animal under his care behaves in a way that grossly disturbs the peace or threatens the safety of third parties. In such a case, the guest will not be refunded the stay fee.
- On the premises belonging to the “Domki Piwniczna” Summer Houses, it is strictly forbidden to pitch tents and park camper cars.
- Independent repairs or modernization of equipment in the houses are prohibited.
- The use of the fire pit and barbecue area is permitted only in the designated area. The fire must be extinguished every time. The fireplace is marked on the overview map on the website domkipiwniczna.pl
- Barbecue and bonfires are only allowed in the fire pit area.
- Guests can use the common utility room free of charge, which is used to store bicycle, ski and stroller equipment, but the Service Provider is not responsible for any equipment left behind. The utility room is marked on the overview map on the website domkipiwniczna.pl
- The service provider may provide services to Go for an additional fee additional services, e.g. providing a laundry room, sauna, jacuzzi, marked on the overview map on the website domkipiwniczna.pl
- The Service Provider does not provide transport and catering services.
- It is prohibited to bring bicycles, skis, sleds or ski boots to accommodation places.
- Smoking is prohibited in the accommodation.
VIII. RESPONSIBILITY
- The Service Provider is liable for non-performance or improper performance of the Agreement, unless the non-performance or improper performance is caused solely by the action or omission of the Guest or a third party for which the Service Provider is not responsible.
- The Guest is financially responsible for any damage or destruction on the premises of the “Domki Piwniczna” Holiday Homes caused by the Guest and persons and animals under his care during the Guest’s stay.
- The guest is financially responsible for lost accommodation equipment.
- The Guest is not liable for any damage resulting from Force Majeure.
- The Service Provider is not financially liable to the Guest for random events not resulting from the direct fault of the Service Provider, actions of third parties, interruption of electricity or water supplies caused by forces of nature, in particular violent winds, downpours, snowstorms, which may result in electrical, water and sewage failures. or damage to the Guest’s equipment. Any such event should be immediately reported to the Service Provider. No refund will be made for shortening your stay for this reason.
- The Service Provider is not responsible for the loss or damage of items brought to the premises of the “Domki Piwniczna” Holiday Homes by the Guest or other persons using the accommodation (especially valuable items) and is not liable for any damage resulting from the use of the accommodation by the Guest or other persons using the accommodation. from the cottage.
- The service provider is not responsible for the loss or damage of the vehicle left by the customer in the parking lot at the “Domki Piwniczna” Holiday Homes.
- The Service Provider is not liable for bodily injury, health damage or other damage resulting from an accident resulting from improper use of the subject of the lease and the area of the Piwniczna Cottages by the Guest and persons indicated by him as staying with him during the rental period. When handing over the cottage to the Guest, the Landlord informs about the rules for the safe use of the accommodation equipment, such as the mezzanine, terrace, stairs, common area, fireplace, gazebo, sauna and all devices in the “Domki Piwniczna” Summer Houses in Piwniczna Zdrój, which the Guest confirms by accepting these Regulations.
- In the area of the “Domki Piwniczna” Holiday Homes in Piwniczna Zdrój, children can stay only under the care of an adult and under their responsibility. Parents or legal guardians are fully responsible for the safety and for any consequences of their children’s actions.
IX. FINAL ARRANGEMENTS
- The person making an online reservation is responsible for the accuracy of the data provided in the Electronic Reservation Form. The Service Provider is not responsible for incorrect selection of the date or incorrectly entered data in the form. If you find any irregularities that cannot be corrected by editing the reservation, please contact the service immediately.

- The contract is subject to Polish law.
- The customer declares that he has been informed about the content of art. 38 points 12 of the Act of 30 May 2014 on consumer rights, according to which in the case of contracts for the provision of accommodation services, other than for residential purposes, the consumer is not entitled to the provisions of Art. 27 of this Act, the right to withdraw from a distance contract.
- If it is necessary to temporarily suspend operations due to force majeure, e.g. a pandemic in the country, natural disasters, a state of war, etc., the customer will be offered an alternative date or a refund.
